Rule 39
Merger of cooperative organizations
: (1) According to section 87 of the Act, when two or more organizations are merged, the following conditions must be fulfilled:-
(a) Areas of work should be contiguous or contiguous with each other,
(b) Organizations should be of the same subject or nature, or even if they are of a different subject or nature, the competition should be basically the same subject,
(c) Direct participation of members and democratic control should be maintained.
(2) In accordance with sub-rule (1), integration should be done in a way that it falls within the local ward, local level, district or province based on the scope of work of the existing organization.
(3) Notwithstanding anything written in sub-rule (1), the joint (cooperative) organizations registered before the 2nd of June 2049, shall not be merged into another organization without the prior approval of the Ministry.
(4) Organizations with only women members should be given priority to merge into organizations with only women members. However, integration will not be done in such a way as to affect the organizational dynamics of organizations established in the backward communities.
(5) When unifying associations, thematic work should be done in a way that matches. However, this bye-law shall not be applicable in the case of associations which are amalgamated as per sub-rule (7).
(6) - During the consolidation of cooperative banks, the registrar Nepal. Prior approval of the National Bank should be obtained.
(7) District or central thematic or multi-purpose cooperative associations which do not have the minimum number of members as per section 4 of the Act existing at the time of commencement of this regulation and which do not include the district or district or central thematic cooperative which do not fall within the subject mentioned in sub-rule (1) of rule 11 Associations should be merged into the respective association within two years according to this rule.
(8) Other conditions, basis and procedure of integration shall be as provided in the procedures approved by the Ministry.
